I dont know how this works in court but I like how the very first thing De Falco did was create absolute evidence he is talking not just to Schettino but the captain of the ship. Next step was to ensure Schettino wasn't oblivious but aware of the damage and the situation, probably cause he expected him to try and lie his way out.
